It has been repeatedly and heavily emphasized that it is not law school without the complete experience of a moot court. Keeping that in mind and owing to the success of the first edition, we are proud to announce the second edition of the National Moot Court Competition organized by SVKM’s NMIMS’ Kirit P. Mehta School of Law in collaboration with National Institute of Securities Market and sponsored by Karvy, Ola, Omkar and Legge Rhythms. The Competition will be held on the weekend of March 16, 2018. Over 30 teams from all over India are expected to participate in the competition.

The Kirit P. Mehta School of Law (SOL) of SVKM’s NMIMS (Deemed-to-be-University) established in the year 2013 approved by the Bar Council of India aims to provide quality legal education in order to meet the aforementioned challenges. We at School of Law inculcate and nourish all the professional virtues in a well calculated and planned manner, without undermining the ‘societal values’. The academics and support mechanism in Kirit P. Mehta School of Law is to facilitate all the determined students to give their best so as to be the ‘Best’ when it comes to application of theory in practice. The ‘Legal Skills’ built by SOL during the 5 years period should enrich a student to convert challenges into ‘benchmark’ in legal world and withstand economic, social, political and judicial scrutiny.

The object of this Moot Court Competition is to promote proficiency in the field of corporate laws. The aim of this competition is to enable students to research and build legal acumen on the contemporary issues in this field. A further objective is to hone the academic excellence in the student community concerning various corporate laws, and to develop their advocacy and research skills in an environment of friendly competition. The competition also aims to provide a platform for law students to exhibit their argumentation skills which are the core part of advocacy.

What is the point of a tournament if the winner isn’t award for their performance. We are proud to announce the following prize for the best speaker, nest memorial, runner up and the winner positions.

  • Best Speaker- Rs. 10,000 and books.
  • Best Memorial- Rs. 15,000 and books.
  • Runner Up- Rs. 21,000 and books.
  • Winner- Rs. 36,000 and books.

To sum this up, the coming weekend is going be full of arguments, loud speakers and a lot of chaos.

3:35 PM- The event finally begins with arrival of the chief guests and a moment of prayer to goddess Saraswati, who happens to be the goddess of knowledge.

3:40 PM- The chief guests are presented with a memento of aprreciation from the Vice Chancellor of NMIMS.

3:46 PM- The commitee head Mr. Pathak and Faculty in-charge Ms. Srivastav encourage the students for the upcoming two days with their words and declare the competition open.

3:49 PM- Dr. Basu is invited to the stage to address the audience. He expresses his excitment for the upcoming two days claims that he is looking forward to it.

3:56 PM- Dr. Saxena, the Vice Chancellor of NMIMS takes the stage to address the audience, he elaborates on the history of mooting in KPMSOL, and ensures that this edition will be just as astounding.

4:06 PM- The chief guest, G.P. Garg takes the stage to grace the audience with his kind words. He talks about his life experiences as a student, his journey in life, and wishes students with luck for the upcoming two days.

4:22 PM- Dr. Basu comes back to the stage for some final words of encouragement for the students and explains the concept of MBA-Law program offered by NMIMS, which happens to be the only insitute in India that offers this program, and the second in the world. 

4:26 PM- The Vice Chairperson of the organising committee takes the stage for a vote of thanks before the closing down the inaugration ceremony.

4:30 PM- It's time for the official photograph with all the participants, The NMCC has officially started!

6:30 PM- The orientation for all the participants of the 2nd annual NMCC is about to begin shortly. The participants are then invited for a Gala Dinner. With this we conclude the first day of NMCC '18.

 

Day 2 (17th March, 2018)- Preliminary Rounds and Quarter Finals.

Welcome to the Day 2 of NMCC '18 Live blog. We will provide you with minute to minute updates of the day's events. Stay tuned.

8:10 AM- The participants have had their breakfast and are ready to display their mooting skills as the preliminary rounds are about to begin at 9 AM.

Courtroom No. 3

Respondent: T-14

Petitioner: T-15

9:12 AM- The judges have arrived in the courtroom and are going through the bench memorials of each team before beginning the proceedings.

9:16 AM- Counsel 1 (Petitioner) begins the proceedings with an opening statement and presentation of facts. Counsel 1 then proceeds with their arguments.

9:22 AM- The judges question the arguments of Counsel 1, who gladly answers all of their queries.

9:27 AM- Counsel 1 has gone overtime and seeks for extension, which is granted by the judges.

9:29 AM- Counsel 1 ends their arguments. Counsel 2 takes the stage and starts presenting their issues and arguments.

9:33 Am- Counsel 2 seeks for an extension of time. Counsel 2 lays down the prayers of the petitioner and ends their arguments. It is now time for the Respondents to take their stand.

9:36 AM- The judges are evaluating the arguments of the petitioner one more time before calling out the respondents.

9:39 AM- Counsel 1 (Respondents) takes the stands and starting their arguments and issues.

9:45 AM- The judges question the arguments of Counsel 1. Counsel 1 has gone overtime and

9:48 AM- The Counsel 2 (Respondents) has approached the bench and is presenting their arguments and legal issues.

9:54 AM- A lot of questioning from the judges towards Counsel 2, who respectfully, responds to all of their queries.

9:58 AM- Counsel 2 (Respondents) has requested for an extension of time which has been granted by the judges.

10:06 AM- Counsel 2 ends their arguments and submit their prayer. The judges evaluate these arguments.

10:10 AM- Counsel 2(Petitioner) takes the stand to rebuttal the arguments made by the respondents.

10:13 Am- Counsel 2 (Respondents) takes the stand makes a quick rebuttal to the arguments made by the petitioner.

10:15 AM- The judges are re-evaluating the case presented by both the parties as everyone awaits to hear from them.

10:20 AM- The respondents and the petitioners leave the courtroom as the judges decide upon the verdict.

10:24 AM- With this we end the proceedings of Courtroom 3.

9:14 AM- The Preliminary Rounds have commenced. There are 5 courtrooms, each being adjudicated by a Division Bench.

9:20 AM- the petitioner speaker 1 has approached the bench and began his argument and is faced with a series of questions by the bench with relation to the team’s memorial and arguments

9:31 AM-The speaker 1 of T09 continues to be grilled under the questions of the judges and the heat in the room is rising

9:52 AM- Speaker 2 of the petitioner side has finally taken the stand and continues to battle very well-read judges

10:10 AM- Speaker 1 of the respondent side has taken up the podium and speaks with an air of confidence

10:28 AM- the judges ask the respondent to justify and respond to the arguments made by the petitioner

10:34 AM- the judges continue grilling the speakers, the trial gets more interesting by the minute

10:41 AM- the judges take a minute to discuss something amongst themselves while the second speaker of the respondent side takes the stand.

11:00 AM- the restlessness is very apparent in the room for it is very rare for a prelim round to go on for such long duration of time, the speaker 2 continues the battle by citing Vodafone Inc. vs union of India case law.

11:05 AM- Speaker 2 rests her case

11:08 AM-  Both the parties leave the room, while the judges work on their verdict. With this we end the proceedings in courtroom 5.

11:00 AM- Counsel 1(Petitioner) starts the proceedings of the courtroom by stating the facts and the issues of the case. The counsel seeks the required time from the judges, which is granted to them and they proceed to present their arguments.

11:04 AM- The judges question the counsel on the validity of the case and the rights that have been infringed. The Counsel 1 clears their queries and doubts without a sweat.

11:08 AM- The judges seem to have more than a few queries regarding the case and are really grilling the Counsel 1. However, the Counsel 1 stands on firm ground and is able to respond.

11:15 AM- Counsel 1 has gone overtime and seeks for an extension, which is readily granted by the judges.

11:26 AM- Counsel 1 ends their arguments. Counsel 2 approaches the bench and commences with the presentation of their arguments and issues.

11:32 AM- The judges are questioning Counsel 2 (Petitioner), who is respectfully responding to all their queries. The Counsel has exceeded the time period sanctioned and seeks for an extension, which is granted by the judges.

11:39 AM- Counsel 2 ends their presentation of arguments and issues and states the prayers of the petitioners to the bench.

11:40 AM- The judges evaluate the case presented by the petitioners and call forth the respondents to present their case.

11:42 AM- Counsel 1 (Respondents) approaches the bench and starts with their issues and arguments.

11:48 AM- Counsel 1 (Respondents) has exceeded the pre-sanctioned time period and seeks for an extension, which is readily granted by the judges. The bench is questioning the counsel and the counsel is trying their best to answer all their queries.

12:00 PM- The judges seem to have a lot of queries and Counsel 1 seems to be running into some difficulties while presenting their case but is trying their best to explain their case to the bench by readily responding to all their queries.

12:12 PM- Counsel 1 finally ended his presentation of arguments. Counsel 2 now approaches the bench to present his case.

12:19 PM- Counsel 2 while presenting the respondents case has exceeded the sanctioned time ad humbly requested the bench to grant an extension which is granted. The bench is questioning the counsel, who is respectfully responding to all their queries.  

12:30 PM- Counsel 2 sums up his arguments and issues and states the respondent’s prayers, then the presentation is ended by the Counsel.

12:31 PM- The petitioners and the respondent have both presented their rebuttals and summed up their cases. The judges ask both the parties to leave the room, so that they can work on the verdict of the case.

12:34 PM- With this, we end the proceedings of courtroom 7. With this we end the first round of Preliminary Rounds. We will be back with the second round after lunch.

Courtroom 3

1:15 PM- Counsel 1(Petitioners) begins the proceedings of the courtroom with his opening statement and a summary of his arguments.

1:18 PM- Counsel 1 seems to be confident about his arguments and is answering all of their questions and doubts.

1:22 PM- The judges are not shying away from taking shots and questioning the counsel’s every move. This is getting interesting.

1:27 PM- Counsel 1 representing the petitioners has ended his presentation. Counsel 2 has now approached the bench and presenting his case by stating arguments and issues.

1:33 PM- Counsel 2 has finished presenting the petitioners case and on the request of the bench is summarizing the arguments and issues stated by him throughout the presentation. The counsel then ends the presentation by stating the prayers of the petitioners.

1:34 PM- After evaluating the case presented by the petitioners the bench has called upon the respondents to present their case.

1:37 PM- Counsel 1 representing the respondents has approached the bench with their permission and is now presenting the respondents case.

1:42 PM- The judges are asking counsel 1(Respondents) a lot of questions and also expressing their doubts, which the counsel is trying to address up to her full potential. The counsel has exceeded sanctioned time period and seeks extension which is readily granted.

1:54 PM- Counsel 1 (Respondents) has ended her presentations and now counsel 2 (respondents) has approached the bench with the permission of the judges. The counsel is presenting the respondents case and she is already being bombarded with questions and doubts by the judges.

2:02 PM- Counsel 2 (Respondents) has exceeded the sanctioned time period and asks for an extension which is gladly granted by the bench.

2:08 PM-  Counsel 2 wraps her arguments and issues and presents the prayers of the respondents before the bench. The courts evaluate the arguments of both the sides before giving them a chance to rebuttal. Both the parties deny the chance of rebuttal and so the judges prepare their verdict.

2:15 PM- With this we conclude the proceedings of courtroom 3.

Courtroom 4.

Petitioner- T13

Respondent- T02

Judges- Anirud Sudarshan and Rinky Deb

2:43 PM- Counsel 1 (Petitioners) approached the bench with the permission of the judges. The counsel then starts presenting the case and their arguments and issues, however the bench has already asking questions and doubts.

2:52 PM- The presentation by counsel 1 has begun and he judges are posing multiple questions and doubts, which the counsel is confidently answering to the best of her potential.

2:53 PM- The judges keep posing trick questions towards the counsel, thereby confusing her about her knowledge. however, she was able to get by them.

2:57 PM- Counsel 1 of the petitioners ends her presentation, and with the permission of the judges Counsel 2 (Petitioner) approaches the bench and commences his presentation of the case by stating the arguments and issues.

3:02 PM- Counsel 2 has exceeded the sanctioned time and seeks an extension which is readily granted by the judges. The bench keeps questioning and expressing doubts to the counsel to which the counsel responds respectfully and elaborates and explains the petitioner’s stand.  

3:11 PM- Counsel 2 wraps up his arguments and issues and presents his prayers in front of the bench. The respondent approaches the bench and presents his arguments.

3:15 PM- Counsel 1 seems to be confident about his arguments and is able to answer all the queries of the judges with a firm hand.

3:21 PM- Counsel 1 has gone overtime and pleads for some extension. The judges grant it but tell him to wrap it up quickly.

3:22 PM- Counsel 1 wraps up his arguments. Counsel 2 approaches the bench to present her arguments and present the remaining issues.

3:35 PM- Counsel 2 (Respondents) has exceeded the sanctioned time period and seeks an extension which is expressly granted by the bench.

3:38 PM- Counsel 2(Respondents)ends the presentation by stating the prayers of the respondents.

3:45 PM- For the rebuttal round both parties (petitioners and respondents) send their counsels to elaborate on their arguments and also explain their stand.

3:46 PM- The judges are now evaluating the cases presented by both the parties and working on the verdict.

3:52 PM- The teams are now leaving the court room. This marks the end of the proceedings of courtroom 5.

3:54 PM- This brings us to the end of the Preliminary Rounds, it’s time for high tea. Stay tuned for the Result Declaration right after it.

01:21PM: Speaker 1 from the petitioner side approaches the bench and begins his argument

01:24PM: The judge asks the participant questions on why should the his petition be accepted and listens patiently to his answer that as the judges comment is based on assumptions

01:35PM: Speaker 2 takes the podium to deal with issue 3  and 4 of the moot problem

01:40PM: Speaker one of appellate side takes the stand and raise firm well framed arguments that impress judges  

02:00PM: The judges and the speaker have an amazing discussion on the rights of the state and the moot problem.

02:10PM: Speaker 2 from the appellant side takes over and argues her case with confidence and is able to dodge the questions that seem like bullets by this hour for the first 5 minutes of her speech.

02:13PM: The judges seem dissatisfied with both the teams as they fail to come up with an apt definition of secure buyers

02:17PM: Final prayers are presented by team appellant and judges declare that the rebuttal round must be short and amount to a maximum of two rebuttals.

02:21PM: The rebuttal round comes to an end with decent rebuttals from both he parties, the courtroom reflects calmness.

5:20 PM-  There is a huge amount of anticipation in the air as the participants await the results of the Preliminary Round.

5:26 PM- The results for Preliminary Rounds are out, the winners are T08, T27, T01, T09, T29, T02, T21 and T10. Congratulations! The brackets for the Quarter Finals will be drawn shortly!

 

Quarter Finals

Courtroom 7

Petitioner- T29

Respondent- T02

Judges- Akshay Puranik and Raghav Pandey

5:53 PM- The Quarter Finals are officially underway. Counsel 1 from the petitioners starts off to a strong start. However, she quickly gets derailed by the quick questions of the judge.

5:56 PM- Counsel 1 tries to find her footing but seems to be having a tough time as the judges are not going to take it easily unlike the Preliminary rounds.

5:59 PM-  Counsel 1 seems to be shell-shocked and startled due to the questions and doubts raised by the bench yet she is trying her best to respond with a satisfactory answer to the judges yet it doesn’t look like the judges are satisfied.

6:04 PM- The judges don’t seem to be satisfied with arguments of Counsel 1 and ask her to move to the next issue.

6:07 PM- Counsel 1 has exceeded the allotted time and asks for an extension, the judges grant it, although they don’t seem to be impressed by Counsel 1. Counsel 1 quickly wraps up her arguments and Counsel 2 approached the bench and starts her presentation.

6:13 PM- Much like Counsel 1, Counsel 2 seems to be having a hard time in convincing the judges about her issues and arguments. It is high time everyone realized that the Preliminaries are over the real NMCC starts now!

6;15 PM- The judges are bombarding Counsel 2 with a ton of questions and queries that she has no answer to, this seems to be going downhill.

6:24 PM- Counsel 2 has also exceeded the allotted time limit and asks for an extension, which is readily granted by the judges.

6:29 PM- Not satisfied with the arguments of the Counsel, the judges ask them to present their prayers before the bench. The Counsel 1 from the respondents take the bench and start with their arguments.

6: 35 PM- Just like their counterparts, the judges aren’t taking it easy on the respondents either. The counsel is unable to convince the panel of judges.

6:45 PM- Counsel 2 (Respondents) seems t be startled by the questions and doubts raised by the judges. The judges are continuously bombarding the counsel with questions and doubts and the response of the counsel does not seem to satisfy the judges.

6:48 PM- Counsel 1(Respondents) has exceeded the time limit and seeks for an extension which is readily granted by the judges. Counsel 1 then wraps up his presentation and Counsel 2 approaches the bench with the permission of the judges.

6:52 PM- Counsel 2(Respondents) has just started presenting the case by stating the arguments and issues, however the judges have already started bombarding her with questions and they do not seem convinced by the responses of the counsel.

6:58 PM- Counsel 2(Respondents) have exceeded the sanctioned time period and the counsel seeks an extension which is granted by the bench.

7:00 PM: Counsel 2(Respondents) have exceeded the sanctioned time period and the counsel seeks an extension which is granted by the bench.

7:06 PM- Counsel 2(Respondents) then states the prayers of the respondents and wraps up her presentation of arguments and issues.

7:10 PM- Both the parties give a point each as rebuttal. The judges then ask them to leave the room, so that they can come with a verdict.

With this we end the Quarter Finals proceedings of courtroom 7.

 

COURT ROOM 06

PETITIONER- T21

RESPONDENT- T08

JUDGES: SHANTANU KANADE, KUSHAL MOR

 

05:59PM: The speaker 1 of the petitioner side has begun her argument, and she seems very well versed with the facts of the case.

06:13PM: The speaker asks for an extension and is granted the same by the judges.

06:16PM: The speaker one rests her case as speaker two approaches the bench to argue issues 1 and 3.

06:31PM: The speaker runs out of time and is given two minutes to wind up his argument.

06:34PM: The petitioners offer prayers as the first speaker of the respondent team approaches the bench to deal with issue 1 and 2.

06:51PM: Speaker two begins his argument and is faced with a number of questions by the judges which he answers with caution.

07:09PM: The speaker ends his arguments and says his prayers after which the judges declare the rebuttal rounds open.

07:10PM: The rebuttal rounds are cold without any enthusiasm shown by either of the teams. It seems like they are done for the day, and the judges sense so too and cut them short.

With this we conclude the Quarter Final Rounds. Stay tuned for the results.

 

Day 3 of NMCC'18 is about to commence with the Semi-Final Rounds.

 

Courtroom: Moot Court Hall

Judges: Biju S., Jai Kishan Lakhwani and Padmaja Dholakia

10:00 AM- Counsel 1 representing the petitioners approaches the bench with the permission of the judges. The counsel then starts presenting the facts of the case, arguments and issues.

10:03 AM- Counsel 1 proceeds with presenting her case and arguments. She seems to strong and firm with her approach.

10:08 AM- it seems that the semifinal rounds are going to go on for a really long time, Counsel 1 is really building on her arguments.

10:09 AM- Counsel 1 finishes her first argument, and the judges now question her.

10:11 AM- Counsel 2 proceeds with presenting her second.

10:22AM- The judges present their queries in front of Counsel 2, who stumbles a bit is able to answer them.

10:31 AM- The judges pose a lot of questions in front of Counsel 2. They are not going to easy.

10:31 AM- Counsel 1 of the Respondents approaches the bench and starts presenting her arguments and issues.

 10:41 AM- The judges question the arguments of Counsel 1. She gladly answers all of their queries and moves on to her next issue.

10:47 AM-  Counsel 1 moves on to her next argument before the judges and despite all the questions and queries from the judges is still standing strong.

10:54 AM- Counsel 1 wraps up her arguments before the judges. The judges pose some questions before her. She clarifies all of their queries before inviting her co-counsel to present their arguments and issues.

10:54 AM- Counsel 2 approaches the bench to present remaining arguments from the respondents.

11:04 AM- While Counsel 2 was wrapping up his arguments rather quickly the bench started posing multiple doubts and queries at the counsel to which the counsel responded respectfully up to his full potential explaining his stand.

11:10 AM- After answering all of their queries. The respondents place their prayers before the court. Thus, ending the first round of these proceedings. It is now time to present rebuttal arguments.

11:13 AM- The time clerks announce that the petitioners have 2 mins while the respondents have 3 mins to present their rebuttals.

11:14 AM- Without wasting any time, the petitioners begin with their rebuttals.

11:17 AM- Inescapably, the petitioners have gone overtime. Extra time has been granted to them by the judges.

11: 19 AM- The petitioners finish their rebuttals. The respondents approach the bench to present their rebuttals.

11:23 AM- Much like their counterparts, the respondents have also gone overtime. Extra time is granted.

11:27 AM- The respondents wrap up their arguments in a grand fashion. We now await to hear from the judges.

10:20AM: Speaker one has left the stand while speaker two now presents his argument with an air of confidence that is rarely seen in tensed times like this.

10:38AM: The speaker and the judges are engrossed in discussion and questions and answers flow back and fourth at lightening speed.

10:45AM: Counsel 1 from the side of respondents takes the stand and begings the argument with a open mind to questions that the judges pose.

11:03AM: The speaker does not have a satisfactory answer to the question of the judges, and is asked to sum up her arguments.

11:07AM: The counsel 2 from the respondent’s side takes the podium as the judges grow more and more diligent by the minute and the speaker is not able to sustain the grilling session and is seen losing her confidence.

11:20AM: The rebuttal round opens up with the counsel 1 of the petitioner side showing remarkable talent that seems to have shaken the audience out of their deep slumber.

11:35AM: Counsel one of the Respondent side takes over for rebuttal.

11:45AM: The session ends.

The Final Round of NMCC'18 is about to commence in a few minutes.

Courtroom: Santokba Hall 

Petitioner: T01

Respondent: T18 

Judges: Sujit Prasad, Gaurav Joshi, Mustafa Motiwala, Suommo Biswas and Soumitra Majumdar.

1:40 PM- We are introduced to the judges in the hall. They order for the Finals to be begun. The Final chapter of NMCC 2018 has begun!

1:42 PM- Counsel 1 from the petitioners reserve their timings with the judges and start oresenting their case in front of them. The judges interrupt her, not even one minute into her presentation, bombarding her with multiple doubts and questions.

1:59 PM- The judges are raising multiple questions and doubts which the counsel is answering respectfully to the best of her potential.

2:07 PM- Counsel 1 wraps her presentation of arguments and issues before the judges. Counsel 2 takes the stand and starts his presentation of issues and arguments.

2:27 PM- Counsel 2 (Petitioners) is being posed with multiple questions and doubts by the judges to which the counsel is elaborating on his answers and responses to explain the petitioners stand in this case.

2:37 PM- Counsel 2 wraps up his arguments, after a lengthy session of doubts from the judges. The petitioners present their prayers before the judges. It is now the turn of Respondents to present their case.

2:42 PM- Counsel 1 (Respondents) approaches the bench with the permission of the judges and begins presenting the respondents case by stating their arguments and issues.

2:49 PM- Counsel 1 is still trying her best to clarify all the doubts, queries and questions asked by the judges.

3:00 PM- Counsel 1 (Respondents) ends her presentation of arguments and issues. Counsel 2 (Respondents) the approaches the bench with the permission of the judges and begins the presentation of the remaining arguments and issues of the respondents.

3:07 PM- Counsel 2 (Respondents) has exceeded the sanctioned time period and seeks an extension, which is readily granted by the bench.

3:25 PM- The respondents wrap up their arguments and state their prayers before the judges.

3:32 PM- The petitioners start their rebuttal round. They have 2 minutes.

3:45 PM- The petitioners have ended their rebuttals and now the respondents have sent their counsel for the rebuttal round.

3:50 PM-  The respondents have also finished their rebuttals and now it is time for the judges to evaluate the arguments and issues presented to them by both the parties.

4:00 PM- The judges provide us with kind words of enlightenment and encouragement while the results are being calculated.

The judges have come back with the results and the petitioners have done it. They are the winners of NMCC 2018!
