Exclusive: Singhania & Partners LLP’s appeal against the Competition Commission of India’s (CCI) majority decision clearing Microsoft of anti-competitive behaviour has been accepted by the appellate tribunal today, which is serving notice to the respondents.
Authoritative sources confirmed that the Competition Appeals Tribunal (Compat) today accepted the appeal, giving six weeks for Microsoft to reply, following three weeks for a counter-response by Singhania, with a final hearing in around 10 weeks.
Singhania first complained to the CCI in August 2010 that the US software maker charged lower prices for its Office suite of software to original equipment manufacturers (OEMs) than it did in bulk sales to law firms or businesses.
But the CCI ruled on 30 June 2011 that the differential pricing did not raise any competition issues. CCI member R Prasad dissented and said that Microsoft’s practice was unfair and discriminatory under the Competition Act.
Singhania said it would appeal the ruling on 22 July, as reported by Legally India.
Microsoft is represented by Amarchand Mangaldas’ Delhi office.
