Naik Paranjpe secures release of Bollywood romance Kites

Naik Paranjpe and Company led by managing partner Ameet Naik has won a favourable order for clients Filmkraft and Adlabs against a suit filed in a munsif court that sought to restrain the release of the movie Kites.

Naik instructed advocates Dwivedi, MP Jha and Subodhkumar Jha on behalf of Filmkraft and Adlabs respectively to defend their case before the district judge of Sitamarhi Court today that disposed off the appeal.

The appellate court stated that since Filmkraft and Adlabs had filed their appearance before the Munsif, Shoehar on 11May 2010 the order of status quo passed with respect to film release by lower court stood automatically vacated.  

The cause of action arose from a suit filed by movie stuntman Laxmi Narayan Prasad against the producers of movie Kites, Happy Hours, Spektrum, Film Kraft and Adlabs.

Prasad sought to restrain FilmKraft and Adlabs from releasing the movie based on his claim of certain copyrights in a storyboard owned by Happy Hours and Spektrum which in turn was alleged to have been used without authorisation in the movie.   

The clients of Naik had objected to the fact that only three defendants namely Happy Hours, Spektrum and Dilip Shah were serviced show cause notice and an appeal was filed against interim order dated 4 April.

The interim order resulted in status quo with respect to release of the film which was slated to happen on 21.05.2010 and was effective till appearance of Film Kraft and Adlabs.
