Hi folks,

Those of you who may missed today’s TOI may not have come across an article discussing , among others , two interesting question which are pending adjudication in a PIL before the Delhi High Court. The questions are:

  1. Whether rendering opinions in writing on a point in issue to be produced in a court of law is a violation of article 124(7) of the Constitution which prohibits a retired judge from acting or pleading before any court or tribunal.
  2. Can retired SC Judges’ advice be used in courts?

excellent posts. thanks. have to admit i had come across this practice tangentially while sevicing clients but had never applied my mind to the issues involved. something does smell bad in the judges' pvt chamber practices even without their holding government or other high offices. whats the latest on this?
