regarding unregistered family arrangement deed

AnonymousLLB 13 Jul 2015, 15:09

Hello Experts,

I explain my situation. Please provide me the legal advise..

My husband father expired on 1981 before partition of property. He had his own business.

After his demise family property transferred to his wife, who has three children at the age of 14 , 8 , 7.

Then the business taken over by the first son. He undertake all incomes from the business without giving any portion to his mother and brothers.

Then the mother bought one land after selling all her jewels which were given by her husband.

from that property the first son got one half portion fully by way of gift settlement.

For this he made a FAMILY ARRANGEMENT DEED WITH HER MOTHER AND BROTHERS without giving any details. That also notaraised , but unregistered. In that deed he mentioned , that , he take over the business, and not interfere in the common house.

But now he is asking share from the common house.

My question

what is the other two brothers situation?

Where they are not entitled for the father’s business share.

Whether the unregistererd deed is valid or not?

******* After first son’s settlement we are only maintaining my mother-in-law.

He is not giving any monetary help to her.

But she is full of his support…*********************************
