I’m from Bangalore, This is Regarding Execution Case filed by my Father (Petitioner) and Respondent who was working in nationalized bank (now retired). Lower court had Ordered Judgment and Decreed against Respondent. So Petitioner filed Execution in the year 2007 and the court ordered attachment of monthly Salary, which was recovered from Respondent month after month Salary. Now the case has been closed (Decision Date 20-12-2010), Now the amount which is credited in court or Treasury has to be taken/claimed by the petitioner. WHAT IS THE PROCEDURE? HOW TO CLAIM THE AMOUNT FROM THE COURT / TREASURY. My Advocate is dragging for years, and Please let me know what all the Certified copies to be applied from the court (Small Causes and Execution) for REFUND. And finally Petitioner has expired last month 2015, what all the documents to be produced to the court. Please help me / Guide me.
