Dear Sir,

I would like to request some suggestion from your end about, what I should do regarding the situation I am facing since I have signed in the papers for giving my consent of getting the Probate of my deceased father’s property to my Mother.

My father had got the land and building property in West Bengal, Barasat in 1990 as gift from one person who he used to look after during old age. They have died and my Father died in 2006. After that, me and my younger brother signed our consent on behalf of our mother to get the Probate in her name for the property. After getting the property in her name she is denying me and my family to enter the house and staying in the house which my Father had built with his money by taking housing loan from his office by mortgaging the deed. She is saying that, she will sell the land and building or gift it to a charity.

Can she deprive me of getting my share in the land and building which I helped her to get in her name? Otherwise I could have asked for my share while I signed my consent to get probate in her name, which I thought will be mine and my brothers right after her.

Please help and advice what legal step I can take to stop her from depriving me and selling the property. Thanks in advance for your help.
