I am working for a IT company at Noida from last ~3.5 yrs. I went for 20 days unplanned leaves due to personal problem. I asked for some more long leaves over the phone and he was sounding very sweet and he said that no further leaves are possible and now we have to plan separation. He asked me to resign which I did.

After 2 days, I got a call from HR that there are some recoveries against me. It is told to me that I went to USA for 2 months and after coming back I have to serve 9 month notice period else I have to pay the US travel expenses. So they have created big recoveries against me. US expenses + 3 month usual notice period amount.

I went to office next day and came to know that they have make my last working day the day my resignation was sent.

After lot of discussion and arguments, they had agreed that if I serve 3 months notice period then they wont ask for any money.

Now, situation is that I can not go to office because of personal reasons. I do not have any work in office. I am seating idle and it is told to me that I can not take any leave.

I had not signed any document/paper before filing visa or before/after my USA travel. My appointment letter doesnt not say any thing like this. It doesnt have any term or condition.

They have asked us to sign an agreement after my joining but I remember that is expired as that was yearly renewable agreement and it is not renewed afterward.

They have given 1 policy document which have this kind of absurd statement.

Now, I need to know what I should do. Currently, I am going to office and seating ideally. I report to a manager who sits in banglore.
