My father was driving car and person driving bike came from front scratched car and fell after driving few distance. Father picked him up and admitted to hospital. He lost his 2 fingers other than toe. Initial Hospitalization cost submitted by father. We are looking for case settlement where we agreed amount with relatives of victim but they are refusing to give it in writing. When we insisted on written assurance they lodged complaint against my sister who was with my father. In complaint relatives of victim said that my sister was driving car while having headphones in ear and due to which accident has happened. Absolutely false complaint has been lodged and moreover at the time of accident no witness was there. What should We do ? We are ready to pay compensation but victim and relatives refusing to give it in written. What happens after that ? What will be the possible end result if case goes to the court ? Does court allows to settle the case mutually or with interference of judge with total medical cost as compensation ?
