Dispute on Landed property.

Hi,

I seek some legal advice. The story starts 35 years back. In 1980 my dad had bought a land in Mangalore (Karnataka State) for Rs.25000.00. My dad has 2 maternal aunties. My grandmother and both her sisters are all staying in the same house. Since at that time my dad was working in Middle East he send over the money to his eldest maternal aunty. At that time the owner of the land wrote in a peice of paper that he has sold the land for Rs.25000 and also mentioned the name of all the 3 ladies (i.e my grandmother and her two sisters).

The land is not registered till date. In 1983 my dad construted a house on that land and all the 3 families were staying in the new house now. Sister # 1 has no childer and she is expired. My grandmother has two children, one my dad and my aunty. Sister # 3 also has 2 sons.

The problem started 5 years back when my dad moved out of the house and construted his individual house in Mangalore. The eldest son of sister # 3 is secretly planning to sell off the property. When my dad came to know he questioned and said that this cannot be done since even he has a right on that land too. My dad wante to register the land and do a partition. hence he contacted the owner from whom the land was purchased. He is now dead and his son and grandson are demanding Rs.25 lacs for signing the sale deed.

But last year my dad expired in a road accident.Post this incidence he never contacted or visited us too. We have been informed by our neighbours that he is again planning to sell off the property. When my mother called him he doesn’t answer her phone call and avoids us.

Pls advice what can be done, since I am not ready to let go my right.

1. The land is not registered.

2. Does the owner or his legal heirs have right to demand money from us now.

3. What legal action can be taken against my uncle.

Pls help, since i have tried with several lawyers in Manglore but they are least helpful.

I have lot of hope from this panel.
