Hello,
I am looking for legal advice and legal help regarding my family property.
My father currently holds in his name a legal property inherited from my grandfather. My father has 2 sons and I am elder one. My father wants to give the entire property to me because the younger son is incapable and a drug addict.
What is the best way to resolve this issue. I am looking for a proven methodology that has been tried and tested in past to solve this case.
The solution should be foolproof and should not allow the younger son to claim property rights in future.

First i want to know whether your grand fther has willed his property to your fathers name or just your father has inherited the proprty after his fathers death in the first case if the G father has gifted the property to your father he is free to do so but if there is no gift deed anything he cannot divide the property both of you have equal rights.

My father has a deed/ will written in his name from my grandfather. So, I understand from your answer that he can grant that property ownership to me . This opens another set of questions in my mind..I would kindly request you to answer those as well.
1. On what grounds can my brother file a property reclaiming suit against me?
2. Will this be a civil case? Can you advise a expert lawyer or suggest a few names from Chennai who are well experienced in handling these kind of cases and assisting me with this property transfer from my father to me?
Finally my third question -> Can you quote any cases that have been won from my point of view in past. Because , I wanted to clarify the grounds on which I can defend the property transfer from my father to me
