Dear Lawyers,
I am a victim of a Cyber crime.Someone illegally obtained a video/videos
of me most likely in my bedroom itself.This happened around 8 years ago
I suspect.I came to know of it in the year 2013.From IT security guys
whom I had hired and my own analysis,I have been under survelliance.
I suspect this had been going on for many decades since my college
days.This illegally obtained information is been continously circu-
lated to tarnish my image.One of my ex-close friends is involved
in distribution,though I suspect the main culprits as different.
I have only circumstantial evidence no direct evidence.How do I
proceed ? Can I lodge a police complaint against my suspect ?
Without any evidence it shouldn’t backfire to me ?

What kind of circumstantial evidence do you posses?
A crime may be registered under 66E of the IT Act in the nearest Police Station
Sec. 66E:
Whoever, intentionally or knowingly captures, publishes or transmits the image of a private area of any person without his or her consent, under circumstances violating the privacy of that person, shall be punished with imprisonment which may extend to three years or with fine not exceeding two lakh
rupees, or with both.
Explanation:-For the purposes of this section -(a) “transmit” means to electronically send a visual image with the intent that it be viewed by a person
or persons;
(b) “capture”, with respect to an image, means to videotape, photograph, film or record by any means;
(c) “private area” means the naked or undergarment clad genitals, public area, buttocks or female
breast;
(d) “publishes” means reproduction in the printed or electronic form and making it available for public;
(e) “under circumstances violating privacy” mearts circumstances in which a person can have a
reasonable expectation that -(i) he or she could disrobe in privacy, without being concerned that an image of his private area was
being captured; or
(ii) any part of his or her private area would not be visible to the public, regardless of whether that
person is in a public or private place.

Circumstantial Evidence:
1.I hired an online security guy who told
various details.But his long gone and his
was an anonymous check.
2.My email,social networking sites and computer
have been hacked into.No evidence to prove this
as of now.
3.I was suspicious of this since a long time,
And in my city with a lot of people smiling
grining and me connecting the dots, I surmised
the obvious.
I know its vague,but its basically connecting
correlating various facts over many years,and
after confronting my ex-friend who promptly
said ’ dont involve me in this ’ implying
that he had a copy of it but the main culprits
are different.
