Bank guarantor fraud
Hi Legal Experts,
I received a call on my cell from a different city from where I stay saying that some one has taken a loan from a bank and made me the guarantor. the person in whose name the loan is is not known to me. I was told by the caller during the conversation that the person who took the loan has not paid the dues and asking them to reach out to the guarantor (which is me). The caller even mentioned about a police complaint against me.
I know for sure that I have not given any guarantee for any loan especially not to this person since I do not know anyone with this name. My suspicion is on someone from my previous company, has taken away my important papers like the pan copy, address proof and photographs to file as a guarantor and my fear is what he/she would have even forged my signatures to get the loan approved.
Request your help to understand/answer the below questions:
1) What can be done on this matter specially since I am not a guarantor
2) Am I liable for any payments for no fault of mine
3) what action can I take against this person who has put me as a guarantor and the bank who gave the loan without my consent or verification
4) What action can I take against the employer who has not taken care of my personal file after I have become an ex-employee for the company
5) Do I need to prepare myself legally against any police complaint?
