Kindly visit www.hcraj.nic.in and under case status of Rajasthan High Court, Jaipur Bench search for:

Special Appeal Writ (SAW): case no. 93: year 2013 (Jeewan Singh vs Bhoor Singh Bagh Singh Trust)

And

Special Appeal Writ (SAW): case no. 164: year 2013 (Bhawani Singh vs Bhoor Singh Bagh Singh Trust)

Brief summary of the case:

Mr. Takhat Singh made Will dated 22.03.1965 and thereby created a public charitable Trust known as “Bhoor Singh Bagh Singh Public Charitable Trust” and donated all his properties worth several hundred crores to this Public Trust in Jaipur (Rajasthan).

Mr. Takhat Singh died issueless on 05.05.1970 and also did not adopt anyone.

Trustees of “Bhoor Singh Bagh Singh Public Charitable Trust” applied for its registration on 27.07.1970 at Assistant Commissioner, Devasthan Department, Jaipur (Rajasthan) on the basis of Will dated 22.03.1965 executed by Mr. Takhat Singh.

Appellant Jeewan Singh objected registration of the Trust on the basis forged Will dated 01.05.1970 executed in his favour by Mr. Takhat Singh.

Another appellant Bhawani Singh objected registration of the Trust on the basis of being adopted son of Mr. Takhat Singh.

Appellant Jeewan Singh filed a civil suit for the properties left by late Mr. Takhat Singh on the basis of his forged Will dated 01.05.1970. Later in 1980, he withdrew his suit, without proving his alleged Will, under Order 23 Rule 1 (1) CPC (abandoned his claim without permission to file fresh suit).

Appellant Bhawani Singh’s adoption claim was denied by Jagir Commissioner, Jaipur (Rajasthan) on 12.12.1967. Bhawani Singh’s appeal against this order in Revenue Board, Ajmer (Rajasthan) was also dismissed after 45 years on 17.02.2012.

Appellants Jeewan Singh and Bhawani Singh are still abusing the judicial process and are not letting the civil suit trial complete on this property even after 44 years have passed. The property which was meant for public welfare are being destroyed by these vested interests.
