Can Ancestral property sold without consent of one of the heir ?

AnonymousLLB 5 Mar 2014, 16:41

my grandfather had 2 wives and my mother is the daughter of first wife. Second wife has 2 sons and 2 daughters. My uncle(second wife’s son) sold our ancestral property without informing my mother. What can I do now to get my share of the property? What is the probability of winning the case, if we file one?

Before completion of Partition suite of the Ancestral Property it can not be sold without permission of all Successors. Does your grandfather distributed all property among his successors( Partition suite) ? if No ,You have a right to claim this property on the basis of Succession act.
