regrading land

Hello,

My self Saurabh George, i live in Delhi and I wanted to talk about a land dispute. My parents originally inherit from Kerela. We have plot in a mountain. However there is private property underneath our property. They have taken liberty to mine and create a large whole. There is also path between the road and my property. We have used that as way.However we have consented with them over buying the road, although they marked ridiculous price on it. So my question is. Is in it our right to have a way. Plus is it “ok” mine 50 feet fall. As I forgot to mention. My father is government servant, he doesn’t have liberty to travel to Kerala or Delhi. Mostly he was abroad working in embassies. He has told his elder brother to hand the property behalf of him. However they were not able to maintain land. Forgot to mention about the mining. Yet they were not informed about no mining by opposite party. What are possible way we use legal action against them.
