Query regarding possibility of a delayed property registration
20 Nov 2013, 09:44
Hi,
My Flat in Mumbai was bought in 1980 by my grand father and since then my family is staying here. My Grandfather passed away year back and the property is in the name of my late Dad and mom. However recently i found out that my flat was not registered back then though we have paid all the relevant stamp duty. it is just that my flat was not registered.
Can someone let me know whether I can register my flat now and if yes what would be the penalty I need to pay?
Any advice on the same will be very helpful.

If the. Seller is availble and willing u may get the transfer deed registered in your name.
Thanks!
But the seller which is the builder in our case is no more. And also the Co - op Hsg society in which I live have already acquired the necessary conveyance. So what next would you suggest I do ?
You can certainly register your flat, but you will be required to pay the remainder of stamp duty as applicable now as against the one paid in the past. You will be requiring documents like adjudication, NOC, Property Card, proof of old construction (it is better to get the document adjudicated in case the building is very old and proper depreciation is not given by the sub-registrar), identity proof etc. You can contact www.lawkonect.com with specific details of your case for an evaluation of the exact penalty that you may be required to pay and also for help in the registration of your flat.
Thanks Andres for helping!
But i recently paid the stamp duty of the flat under the Amnesty scheme in the year 2008. Then what is this remaining Stamp duty? Do I have to again pay up the stamp duty just for registration of my Flat?
