Would like to know how this section of CrPC operates. I know that for death sentences it remains a prerogative of the state but how about other cases, and on what circumstances state should exercise this option, in the past how many times it has used this option and what is the check against arbitrary application of this provision. And how many times in the past did the highest courts intervene in such cases. Please let me know.
