Right to Residence of Property.

AnonymousLLB 17 Oct 2013, 13:28

My father and his five siblings were granted the right to share 50% of my grandfathers share(which my grandfather got from his unmarried sister’s intestate property). My father expired in 2010, due to his transferable job we were not in the possession of the property. My uncle possesses the whole property, it is a huge residential property(1000 sq. yards), my uncle is not permitting the right to residence to me.

Do I have the right to residence of my father’s share, how can I get it?

file a partition suit against him before civil court

Can I get the right to possession of some part of property by partition suit?

Or can I sue him for contempt of court because the court has already announced 50% share to the heirs of my grandfather(C) in 1991, my grandfather died in 1990 so the court gave it to his widow and heirs 50% of the property and other 50% to my grandfather’s younger sister(B). It is the property my grandfather’s elder sister(A).

Thanks

If there anything written about it you can definitely file a case against them.
