My father has a residential property in Delhi a part of which(one room) he had rented out two years back. The tenant was very irregular in paying the rent and he stopped paying the rent since last six to eight months. Every time when contacted he used to ask for more time. Recently he has given a court notice to my father alleging the following:-

a) That my father is threatening him to vacate the room

which is incorrect since he was told to vacate so that the building

can be rebuilt being unsafe to live in and because he wanted to remake it

for me to stay after retirement from army.

b) That he has been paying rent on time and that he paid Rs 50000/-

as security (which he did not).

As per the court notice, my father was to appear in the court on 17 Sep 13 but could not since the notice was not served to him and he was informed on tele by the tenant after which my father collected the notice from post office on 18 Sep 13.

The said residential building is in a dilapidated state and contrary to the rent agreement, the tenant is using it for commercial purposes.

The rent agreement has not been extended after Dec 2012 since my father has thereafter been asking him to vacate the premises so that he can start rebuilding it for me to stay after retirement (Due in next five years).

I request the lawyers to please offer advice on how to proceed further and how is the situation with legal point of view, I shall be greatful for your advice.
