can police file case for scratches on car which is parked on road
Sir,
I was called to the police station yesterday due to a complaint given by first floor tenant for scratches on his car. I stay in the ground floor and the owner is in Kolkata.
Background:
I have been staying in the house for the last April 2010 and I used to park my car inside the compound and I vacated this premises yesterday. I stay with my father, mother and brother. Last year the around April -May the first floor person moved in. Around June 2011 his son had scratched my car couple of times while removing his bike and I had parked the car little ahead and he had come into my house in the night threatening me and my family saying car needs to be parked back or outside on the road as I am not the owner. Immediately to had parked the car back to avoid any further arguments. Two day later my father had stroke attached due to high BP (he is not a BP patient).
With my father falling ill he now started to misbehave with me and my family threatening regularly. We avoid him maximum. Very recently his son had again dented my car with his bike, had scratched my window glass too.
I had complained to owner of his behavior and he was asking me to adjust for couple of months as he was shifting by June. Final I decided to shift from this place. The shifting was schedule for 10 Aug 2013. On the day of shifting I had not seen his car from morning. Finally, when we started to load our items to the van and my friend who was monitoring the loading outside was abused by him and then we goes and gets a police man saying we need to come to station and we had scratched his car previous day as we plan to shift on 10 Aug.
At the station too he had miss behaved with my friend was using bad language to me and my brother in front of the police women and men. According to him we had scratched his car and we need to paint his car and two bikes and give him. The police took his complaint on a plain paper. I too gave a counter complaint which the lady police was very reluctant to take she even refused to give me a paper and pen. I was helped by another police man there for filing complaint. After I had written submitted my complain and contact details the police said they will call us to the station when the station head comes.
I am working in Whitefield which is very far away from by residing place. I will not be able to reach the police station when they call me from work. Can I say that to them on the phone?
Please advise me how to handle this situation. How can anyone file case without evidence and can police use their force to pay up? Please advise.
