illegal construction

Hello,

My neighbour has raised the height of common compound wall from 3.5’ to 8’.He is not ready to demolish it. He does not listen to our society management either saying there is no rule in society constitution about common wall. What can be done?

! can I file a case against it? if yes then will the illegal wall remain till the case is resolved?

Can I get a stay order?

In whose land has your neighbour constructed the wall? Is it a common property or his personal property?

thanks for your reply Sir. The wall is common compound wall between two bungalows ( mine and neighbour’s bungalows) .Now the height is raised from 3.5’ to 7+’ so it is blocking sunlight and air coming to our house as our windows and the main entrance and main potion of the house can not have light or air. In the backyard he has a shade so no light or air coming from that side+ he has covered balconies of upper floor by constructing walls so upper floor too does not have light or air. Please do help me.Thanks. regards.
