Foreign company issues with indian contractor
Hello to all,
On February 25th 2013, my Canadian video game company entered in a contract with an Indian firm specializing in 2d and 3d art assets for video games, established in New Delhi. Half of the contract was paid at that time, which is an amount under 10 000 USD.
Between the contract effective date and today, I have been given art assets of poor quality, very different from the quality we had agreed upon in e-mails and Skype conversations. I also learned that a number of assets he provided were actually copied from a source they do not own the rights to.
My contract has clauses ensuring that I get reimbursed if I need to deal with a separate artist to complete the work. About a month ago, we mutually agreed that I should hire another another artist to unload some of the work. However, they have refused to reimburse me per the provided clause in our contract. Now that they have proven themselves untrustworthy, I wish to get a full reimbursement of my fees.
So, in summary, I need a lawyer to represent me in either mediation, or a lawsuit if necessary. I have sought a number of law firms in New Delhi, but so far have received few responses and fewer followups. I would be much obliged for any help concerning this matter.
