I have booked a flat in a project of private Builder. The possession of the delayed by the Builder and Builder is paying penalty by cheque. By mistake Builder has given a high value (i.e. Amount mentioned in cheque is higher value what is expected). What should I do?

by high value, it has be clear what you mean.
was he suppose to give you a 1 lakh cheque and he has given a 1 crore cheque ?
or was he suppose to give you a 500 rupee cheque and he gave you a 5000 rs cheque.
In any case, my suggesstion would be to present cheque and return the excess to the builder (purely on ethical grounds)
if the cheque bounces, tell him to give you a fresh cheque of the right amount and return the bounced cheque to him. dont return the bounced cheque before he gives you the fresh cheque.
I would be business like and fair in this case. mostly because, I don’t trust builders (the nature of their business permits high variability between promise and delivery) and acting fair defines who I am.
