Issue of Road for way out from house--
Dear Sir,
I am from Uttar Pradesh. Recently we have built a house on our land but have no any road to get entrance and exit. In front of our house our uncle’s agricultural land situated. After mutual understanding between him and me that he will provide the road from his agricultural land, we started making our house. But after completion of the House he is not ready to provide the road from his land. Now we have no any road to way out from our house. While we requested from him to give us some piece of your land by taking some money but he is not ready to do the same. Now we are helpless and have not enough money to built another house. Some people are saying to wait till the chakbandi. Once the chakbandi will come you will get the road but its become long time chakbandi not come yet. We are facing lots of problem without road.
Kindly help me. Is there any way to get ride from the above issue. Please give your valuable suggestion regarding the above problem.

A person can not be denied access to his house or their property. You can file a suit and ask for a right of way to reach your property. But the most important point to consider here is that it should be the only way to your property and you should not have any other way to reach your house.

Dude, I don’t know if you need to obtain any regognition or certificate from your village authotity to build a brick/ earthen structure for residential purposes on a commercial agricultural land. Other wise, you have easementary right over your uncle’s land. Please refer to Illustration (a) of Section 4 of the Indian Easement Act, 1882.
