Dear Sir,
I belong to ASSAM, I need your expert advice regarding my Land.
We have a family land in the name of my father and my uncle. Uncle sold his part of land in the year 1990 to my father and provided a Rs. 5 affidavit declaring his part of land to be owned by my father. Now my uncle has expired few months back and we need to transfer the whole property in the name of my father. We are currently holding the entire property. However non of my uncle’s children are claiming over the property still I can not approach them for any other document as I can’t trust them. Since I don’t have any other document as a proof of sale agreement between them, so please suggest me whether the affidavit that I have is sufficient to transfer the property.
Please help me as I can not approach anyone here.

The land can be transferred only by way of written sale deed which is compulsorily registered. Without registration of sale deed the transaction is not valid in the eyes of law. Mere affidavit regarding transfer of land does not confer any right on the transferee.
