Accident by a rented lorry
Hi,
I need to get some answers here urgently. My sister hired a lorry to shift her household stuff to her friend’s place. When the lorry loaded with my sister’s stuff reached her friends apartment premises, it stopped at the entry gate. At that time there was only one guard on duty, who directed the lorry driver about which way to go. When finished talking lorry driver backed up the vehicle to turn into driveway. At the time of backing, a very small child (who was son of the guard on duty), got under the vehicle and died on the way to hospital. Lorry driver flew the scene within minutes of this happening. At the time of accident, my sister and her friend were on a separate bike little ahead of the lorry.
What are the legal implications of this on my sister? How can my sister help in this scenario?
Awaiting prompt replies,
Thanks,
Savi

Sorry to hear about that, sounds like a very tragic series of events.
Just at the outset, I don’t think there should be any liability of your sister - she was not in direct control of the lorry driver or his permanent employer or anything, right?
This is just a gut feeling reaction though - will see if some lawyers can shed more light.
Thanks for your prompt response. I also feel that she is not responsible for this.
Also, I do not think she was in direct control of the lorry driver in any way. She just hired this person to deliver her items from point A to B. But, I guess when it comes to real life, nothing is as simple as that.
I would really appreciate an expert’s opinion on this.
Thanks,
Savi
