Economic and less time taking method to get the ROR of a land coming under pre-settlement category
Hi Sirs/Madams,
I have a agricultural land, which was acquired by my father(alive) as per partition deed in the year 1958. And the side plot belong to my uncle(alive) as per that deed only. But during settlement, the ror of our part of land is recorded in my uncle’s name and his part is recorded in my father’s name. But possession and enjoyment of the lands are as per partition deed only. In 1990, one rectification deed was made by the two brothers(my father and uncle) for this wrong ror. In the rectification deed, instead of “Hall Plot No.” of the land “Old Sabik Survey no.” is written. So our mutation case for issue of rectified ror was dropped quoting this is a pre-settlement case and the concerned Tahasildar has no power for issue of ror for this property. We have constructed a small commercial building over this land and the balance part of the land is used for cultivation purpose. We are depositing the revenue tax for the land as a depositor since last 15 years and my uncle is depositing the same for his part of land whose ROR is in my father’s name.
My father is now around 73 yrs old and uncle is 80 yrs. old. Uncle is co-operative for any legal support required for change of ROR. Co-operation from my cousins can not be ascertained. I want an economic and quick method for settlement of this problem. Also I want to know if my uncle sales the part of land (which really belongs to us but ROR is in his name) to me with out signature of my adult cousins , can i get the absolute legal ownership free from any litigation in the future.
