Firstly if he is in india where are you??? are you a foreign national??

Secondly, what religion and the procedure of marriage was followed both in yours and the second wife??

are you separated or divorced??

bigamy is illegal and punishable by law in India.

assumption is that you are the “second wife” assumption two: you guys are hindus/ same religion/ non-muslims.

strictly legally speaking you are not his wife and cannot seek maintainance.

however under the hindu adoption and maintenance act, you can seek maintenance for your son. while legally being the second wife you cannot get maintenance, from experience I have seen that the courts (unwritten rule) also keep in mind the mother who has been cheated, while directing maintenance payment.

if you really want to screw the bastard, file a police complaint for cheating.

trust me, on these facts he would go to jail “and” be liable to pay for maintainance.
