delay in joining in service due to wrong medical report

a candidate selected by Public service Commission reported to join his duties ,He was asked to go for medical examination, but the medical board declared him medically unfit.He appealed for his remedical examination by higher board.He was examined by higher board and he was declared fully fit and he joined his service after one year.As per rules he should be declared fit on the first day of medical examination.Doctors who first examined him were not aware of rules.Can he seek legal course to include that one year to be part of his service for all practical purpose like time bound promotion etc his cadre get promotion after 5 years 10 years of service due to delay in joining his promotion will be delayed by one year.and his junior in merit list will be promoted ahead of him as thay have complted the 5,10 years tenur one year earlier to him .please advice ??idf there are any judgement please quote
