We have a G+3 storied house in Karol Bagh, New Delhi. In 1982 for constructing the house, my father built six shops on the ground floor and gave five on rent (pagadi system - wherein upfront payment is taken and some monthly rental is fixed). In 1990 my uncles moved out of the house, selling the first floor to one of our tenants. In 2005 my father registered one of the five rented shops in the respective tenant’s name. We have the ownership of five shops out of which one is in our possession. I wish to get the same shops vacated from the tenants as the monthly rental that we receive from them amounts to Rs. 350 per month per shop. Please advise what legal action can I take to get the shops vacated and what are the odds of us getting a favourable ruling?
