Is a summary dismissal of a suit an order or a decree? For e.g., if while rejecting an application for examination of a witness if a judge says,“I am not inclined to accept that a patwari can be a pertinent person to give evidence in a case of this nature. The relief claimed is rejected. Otherwise too, the case of the plaintiff does not command any confidence and the same merits a summary dismissal.”

Please clarify whether this is a decree or an order, and also, why?
