Cheque Bounce Plz help

ajaysinha 8 Dec 2012, 13:43

Sir,

I had invested in company in june2010.In feb they given me principal amount cheques back to us that to drop in banks & company said that we loss all money of all investors and they windup their business. after that i dropped cheque and its got bounced coz of no fund in a/c, so as per rule i filled case in court in dec2011.

case filled and notice sent to all directors of company, in march 2012. 3 directors caught by mumbai police and 1 director fly away,

now on 1st hearing in jun2012, the lawyer came from their side, he was lawyer of 1st and 2nd director while 3rd director has his own separate lawyer. he didnt came on hearing,

lawyer request to judge ,need time to study and judge granted for month,

so in aug2012, again lawyer came alone , not with that 2 directors also 3rd director and his lawyer was absent on 2nd hearing,

At hearing in front of Judge…

Judge: where is companies 2 Directors? why they r absent?

is there any chances of compromise?

their lawyer: plz dismissed this case.. coz only 2 directors r available and other 2 directors r not?

judge: you r lawyer of only 2 directors? so talked about them.

their lawyer:okey

judge:next hearing bring them.i want to ask them.

their lawyer:okey

so 2nd hearing completed.

i read in news paper that from 1st jan2013 there is changes in dishonour cheque., like 2yrs prison , what is new circular released?? plz tell me in details.

also about my case:

i have signed cheque and its signed by 3rd director.

also i have agreements & its signed by 2nd director b8 its xerox copy, original they have..

so what will be my next step to recover my money?

there are 10 cases lodged in courts.

what if they said we cant pay you? then…

my lawyer says, they(2directors) will pay u 50% take it.. he just thinks like that..

and when other 2 directors will come then we talk about it.

its like he is talking from their side.

what i do, sir? need help..
