His legal heir will need to file a petition against the driver, owner and insurer of the vehicle that caused the accident. Details can be obtained from the police station where the FIR was lodged. The petition needs to be filed before the Motor Accident Claims Tribunal. Approach a civil lawyer for this. Beware to touts and advocates, many of whom are tied up with the cops, who promise to handle the matter for you, and take signatures authorizing them to represent you.
