Require legal Advice on cheque bounce

Hello,

My family have given few lacs to our neighbor some time back. That neighbor have given 1Lac cheque dt 20 Aug 2012.Now that neighbor is saying that I should not present his cheque as their bank don’t have sufficient funds in their account.

He is neither returning my amount. He is just giving dates from last 6-7 months.

What is the legal action i can take against him? As such as an evidence, I have his 1 Lac cheque and a white paper note in which he has signed saying that he has to give amount to me.

I have doubt on his intentions now. Also I fear that he will run away from his place.

Pl. help. which legal action I can take against him.

Ask him to issue another cheque in lieu of the existing one and get him committed in writing when the cheque should be presented and get it dated the same on cheque. Present the cheque within 3months from the date of issue. Have witnesses sign the commitment on paper.
