advice on paternal property

hello,

we have a house which belongs to my father.from last 30 years my fathers elder brother and his family were staying there.just few months ago suddenly my father died .as we are four sisters my mother and my sisters want to move to that house.but my uncle is not ready to move out of that house,and he is also not allowing to let us stay in that house as he want to occupy that house.and he is also threatening us to put a stay order in our house so that we cannot sell it.can he really put a stay order?? as the house tax was being paid by my father from last 30 years and also they were not paying any rent for that house.can they really occupy our house??please advise.

Who did the house belong to? Was it your father’s? Was it your grandfather’s? In whose name is the property registered?

If it is your father’s, you can immediately file suit for possession along with criminal complaint of attempt to cause grevious harm, fraud, etc.

If is your grandfather’s, you may have to share the property with your father’s elder brother in which case a Partition Suit will be required.

thanx for replying. actually the house is in my fathers name.it was purchased by my grandfather but in my fathers name.my uncle has another land it was also purchased by my grandfather but in my uncles name.but my uncle is not allowing us to stay in dat house.wot can we do to get our house back..please advice…
