:( we 4 brothers are part of a flat in mumbai according to the will of my mother. 2 brothers were staying with my mother in the flat. now she is no more and still they are staying in the flat. we have applied for probate. And now past 5months the probate is not thru. according to will the property was to be sold after 6months from the demise of my mother. her demise was in march applied for probate in May. the probate should have been done by 6 months, since all are agreeable to the will. but the matter is prolonging. we would like to know if the 2 borthers can still stay in the house or they can be evacuated. when we tried telling them to evacuate in Sept. they said will does not specify of evacuation. While we said that will does not say of staying in the flat. We asked the advocate too fasten the process, but she said that it will take 3-4months more, that is till Jan. we would like to know that by staying for 11months in the property, will the 2 brothers be a legal owner of the same or not? Kindly advise.
