I am a software professional. I resigned from my previous company two months back and have joined another company. As per my employment agreement with my previous company my salary was split into two parts. Part A would be paid on a monthly basis and Part B was mentioned as bonus and would be paid additionally completion of every 6 months.

e.g. if my salary was supposed to be 20,000 the following is the split

Salary: 18,000 per month.

Bonus: 2,000 per month paid on completion of 6 months.

My aggregated additional payment was due on February and I was not paid. On enquiry I was said that it would be paid soon, may be in a couple of instalments. Also, my release letter was put on hold saying that it would be given to me once the dues are cleared.

Now, when I am asking for my dues, I am being said that I am not eligible for claiming any dues and thereby for any payment because it was a bonus based on performance and my work evaluation does not come up with any positive signs. However, there was no mention of any performance related issues on the employment agreement and even when I queried why it is mentioned as bonus, I was said that it is so because one cannot get salary twice in a month and I need not be bothered.

Please advice.
