Property Dispute between Uncle and Me
Greeting Sirs
My father had applied to MIDC for plot and shed to be made use of for industrial work. He possessed an ITI degree which is mandatory to apply for land and MIDC allotted one plot of 10,000 sq. ft. and built shed of 2,000 sq. ft. in my Father’s name in the year 1974.
The total cost of this venture was Rupees 2 lac and MIDC offered it on loan with a downpayment of 0.5 lac rupees. After the down-payment was made, my father began production and manufacturing which did not go well due to a shortage of manpower.
Post this after 7-8 years, my father, in partnership with my uncle started a transport agency. In 2004 all payment of the land alongwith interest was made by my father and he applied for Final Lease Contract. MIDC verified the plot and finding no industrial production in place stayed the Final Lease procedure.
Uncle was not co-operating with my father in obtaining the Final Lease and therefore it remained as it is. My father passed away last month while my uncle was still in partnership.
I, as son and heir to my father’s property, dissolved the partnership with my uncle and asked him to empty the shed of his things as I planned to restart industrial work there but he does not vacate the property.
He has quarreled several times over this matter asking a 50% stake in the plot. What legal steps can I take to prevent him from claiming my property?
Thank you Sirs.
