a candidate selected for a officer post by state public service commission reported to join his service from where he was directed to go for his medical fitness as per rule as joining in service is only allowed after medical fitness but on medical examination he was declared medically unfit on the ground of high myopia it means he is using glasses ie spects more than the permissible no.Candidate appealed to his appointing authority for his remedical examination by higher board .he was reexamined by three eyes specialist doctors who examined his retina and his retina was normal so he was declared fit to join service but in this process he lost one year of service.The rule says if a candidate have high myopia that means using glasses of high number he should be examined by three specialist doctor on same day and if his retina is normal he should be declared fit to join service.But the doctors who initially examined the candidate were not aware of that rule which states that every candidate who is declared medically unfit on the ground of high myopia should be examined by three eyes specialist doctor on the same day and if his retina is normal he should be declared fit on same day but due to lack of knowledge by authority candidate lost one year in service can the candidate get claim to include that one year to be the part of his service which he lost due to official mistake can he get all the benefit of service including financial benefit
