cheque bounce and delay in payment

Dear Sir,
I am supposed to receive INR 5 lac from a builder.
He has issued mu a cheque (dated 1st Jan 2012)of INR 5 lac which was bounced on 15 Jan 2012.
Since then he has been delaying for a payment. As window for issuing legal notice has gone, what should I do now?
1.As per new regulation (from april 2102) whether cheque issued by builder is still valid?
2.Can i still issue him a legal notice? Even though i am late to issue a legal notice ,is he punishable under law?
3. if at all we issue notice and file a Criminal Complaint directly in the Criminal Court, how much time it takes to resolve the issue?
4. including application fee, advocate fee etc approximately how much it will cost me?

Dear Sir,
Please note that in case you to take action against the builder in respect of the bounced cheque you must take immediate legal action as the cheque is due to expire in the month of June i.e by June, 30. Please also note that the new regulation is effective for prospective cheque and no cheques given before 1st April, 2012 therefore your cheque is stil valid.
