framing of issues

what is this framing of issues >> last june 2011 , judge dismiss my case on default on date of framing of issue, advocate deliberately not appeared , judge called 20 times in four hrs every 12 minutes > he mentioned in his order > file attaching herewith, advocate the end … new appointed… three four dates case restored… again on 6th April new advocate not appeared …what happened on date >>> no firm info to date…ok
my question is what is issue framing ????…please advise…

Dear Mr. Sushil,
Framing of issues is covered unser Order 14 of the Civil Procedure Code. Under this the Court frames questions upon which the case is decided. Framing of issues is basically questions formed and the order of the court is passed on these grounds. You may submit the draft issues to the Court but it is the Court which determines as to what are the relevant questions arising out of the controvercy.
Secondly, it’s bad that your lawyers are not appearing. Please appoint a good lawyer who doesn’t screw up your case. Also you may ask the Court to proceed in case you do not want to submit draft issues. Check with the Court Clerk as to what is the next date in the matter. A separate cause list is maintained with the next date written on it.
