when authorities states (GHMC Cheif City Planner ) say that due to writ is pending in the high court on the said land for ownership the prima facie title cannot be decided. now the case is still pending in Hon’ble high court and the same authorities of GHMC have RECOMENDED to grant permission for construction the other party. Is somewhere in the law you state that land is in dispute and no prima faice title can be given to either parties and in other hand recomend to give permissions to one of the parties for construction when the case is still pending
