Problem getting Tresspassers evicted

AnonymousLLB 13 Apr 2012, 12:09

hello everyone,

I am looking for some decent advice for eviction of some trespassers who have illegally occupied some part of land owned and possessed by me. We own a plastics manufacturing unit and had our property closed for a long period of 16 years. when we re-opened, we saw thAT OUR NEIGHBOURS had broken open some part of our compound wall and entered into our premises and started using the same. The said neighbours own the neighbouring unit and the survey numbers for their unit and ours is common. They claimed that the piece of land trespassed by them belonged to them and filed a false suit against us. In the said civil suit, the court ordered officials of the DILR to demarcate the area owned by us and it was found in such demarcation that the said disputed area falls within our part of the land. The civil court has ordered and declared the demarcated area of my ownership and possession. But the neighbours are still not leaving the area and are creating nuisance if we try to close the entrances so created by them. They have also challlenged the said order in the high court 5 months back but till date the high court has not given any injunction against the order but the appeal from order is pending. The police is reluctant to put hands saying that the appeal is pending in high court. Kindly give me appropriate advice as to how can the said area be evicted legally and the trespassers can be put out of the said property.

Regards,

MKT
