There is Three son of Father, Fathers die before doing partition among sons

Now Two son got possession while one does nt have Can he Clam that Property( home) …? that Third Son live in the same home Since last 30years and before 8 month he vacant this house due to emotional tress by other son…

If there is no Will, the third son can claim his share by seeking a partition.
