Taking ex-husband to proceeding

Hi,

I hope you can guide me.

I separated from my ex-husband in 2007; divorce was granted in 2011. However we have a flat which is rented out, although he is supposed to pay the mortgage every month using the rent money, he tends to make late payments or withdraw money from the mortgage account; so the balance hasn’t come down as planned.

I have finally managed to put a block on the mortgage so that he stops taking money out. But I would like to get released from this commitment. I asked him to buy me out or sell the flat but he doesn’t responde to any of my requests. I have hired a solicitor who suggested I could go to proceedings.

Questions:

1- What is the probability of winning this case?

2- How expensive is to go to proceedings?

I don’t want to end up paying too much money without getting a positive outcome.

I don’t know what to do!!!
