Division of property

Hi All!

Needed a little guidance in resolving a dispute around my grand father’s property.

This 402 Sq. Yards plot was purchased and constructed by my grand father in 1947.

Both my grandparents passed away without making a will. They have 5 children (in order from the eldest to youngest):

Aunt-1 Living

My Father Living

Uncle-1 Living

Uncle-2 Living

Aunt-2 Deceased

The 3 brothers haven’t been able to draft a division plan as Uncle-2 is cunningly eyeing the major corner road facing portion which lone amounts to about 50% of the plot.

We currently live in Mumbai and he property is in my native state Rajasthan. Some of neighbours informed us hat there was a break-in attempt on the property during which a compound wall was broken. Following this my father got afraid about a possible illegal capturing hence both my parents are living there for last 2 months. In the due course we have got the electricity connection in my father’a name.

Now we want a peaceful resolution which my uncles are not for.

Can anyone advise what legal recourse we might have.

Any guidance at all will be highly appreciated.
