Cheque Bounce Case - Police Authority

Sir,
Some senior Citizen Lady aged 78 yrs purchased a second hand car from an agent. Since the vehicle is not working to her satisfaction, she returned it and he paid back by a cheque, which was returned back without payment. Can She approach Police as a Senior Citizen (Parents Maintance Act 2007) or she has to file criminal case u/s 138 of Negotiable Instrument Act?
or whether she can file a cheating case of selling a useless car?

She can file a suit for recovery of money alongwith cost and interest under Civil Procedure code. She can also file a criminal complaint u/s 138 of NI Act, a notice has to be sent to the other party before a complaint is filed.
