Buying an old property

rahulasher 2 Mar 2012, 08:22

Hi All Knowledgeable People,

I am planning to buy a flat in a Mumbai building that is more than 35 years old. The sellers of the property (3 brothers) do not have any documents other than their names on the share certificate. I checked in the society office and they also don’t have any document other than the share certificate. This property was bought by the father of the current owners and then was transferred on the name of his 3 sons after his death. Please note that there was no will from the father to transfer the flat to the sons.

Request you all to provide me the details on what legal process do I need to follow to acquire this property.

Thanks,

Rahul
