So if I understand this corrcetly, your brother is in employment of an MNC. Please check as to what date is mentioned in the contract for commencement of his services in the Company. That is not an issue here it seems. However, you have not mentioned if your brother had signed any bond wid the company. Please elaborate if this service agreement for 2 years was actually a bond. If yes, whethere your brother had deposited any money with the company and in turn they had provided training to him. Generally in companies (without bond) there is notice period clause which one needs to invoke before one’s services are relieved from the company.

Having said that, it is reasonable that your brother cannot carry on the job due to his problem.

Yes he had signed a service bond on RS.10 bond paper…

he has resigned and his last date is on 27th feb… but the service bond period is till 9th march.(matter of 10days)

he had not payed any amount to the company for training.

the company does not have his original documents also… they are only asking us to pay the amount for the breach of service agreement. yes …he cannot work for a while as he is going thru treatment. I want to know whether this is a breach of agreement as he is facing medical problem. what can the company do here…what would be the consequences? pls advise
